Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your access to and use of the inclusive.software website, dashboard, and monitoring products, including Tree Watch (together, the “Service”). By creating an account or using the Service you agree to these Terms on behalf of yourself and, where applicable, the organization you represent.

2. The Service

The Service monitors web pages you register for accessibility regressions by capturing accessibility-tree snapshots, comparing them against approved baselines, and alerting you to changes. The Service supports — but does not replace — expert accessibility review, and use of the Service does not by itself constitute or guarantee compliance with any law or standard, including the European Accessibility Act, EN 301 549, or WCAG.

3. Your responsibilities

You may only register pages that you own or are authorized to monitor. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must not use the Service to scan third-party sites without permission, probe or disrupt infrastructure, or attempt to circumvent plan limits or access other customers’ data.

4. Plans, trials, and billing

Paid plans are billed monthly in advance through our payment provider, Stripe. Free trials convert to no access (not a paid plan) when they expire unless you subscribe. You can cancel at any time from the billing portal; cancellation takes effect at the end of the current billing period and fees already paid are non-refundable except where required by law. We may change pricing with at least 30 days’ notice.

5. Your data

You retain all rights to the pages you monitor and the data generated for your organization (snapshots, diffs, reports). You grant us the rights needed to operate the Service — to fetch and store snapshots of your registered pages and to process them for diffing, alerting, and support. Our processing of personal data is described in the Privacy Policy.

6. Availability and support

We aim for high availability but the Service is provided “as is” without uptime guarantees unless agreed in a separate enterprise agreement. Scheduled scan timing is approximate. We may modify or discontinue features with reasonable notice.

7. Liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid in the twelve months preceding the claim. We are not liable for indirect or consequential losses, or for losses arising from accessibility issues the Service did not detect. Nothing in these Terms excludes liability that cannot be excluded by law.

8. Termination

You may delete your account at any time. We may suspend or terminate accounts that breach these Terms, with notice where practicable. On termination we will delete or return your organization’s data within a reasonable period, subject to legal retention requirements.

9. Changes and contact

We may update these Terms; material changes will be notified by email or in the dashboard at least 14 days before they take effect. Questions: hello@inclusive.software.
